Electus Mobile Application

1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of the Electus mobile application ("App") provided by Electus ("we," "our," or "us"). By accessing or using the App, you agree to be bound by these Terms and our Privacy Policy.

2. Description of Service

The Electus App is a companion application for the Electus Online game. The App provides:

• Character profile viewing and statistics
• Game announcements and news
• Event notification scheduling
• Leaderboard rankings
• Bonus features (Bonus Spin, Alchemy)
• Community chat (Global Chat, Guild Chat, Direct Messages)

3. Account Requirements

To use the App, you must:

• Have an existing Electus Online game account
• Be at least 13 years of age
• Provide accurate login credentials
• Maintain the security of your account

You are responsible for all activities that occur under your account.

4. Premium Features

Certain features within the App require Premium status. Premium status is determined by your in-game account and is obtained by using the "Premium PLUS" item within Electus Online.

4.1 No In-App Purchases

The App does not offer any in-app purchases. All transactions occur outside the App:

• Premium items can be purchased using Gold (free in-game currency earned through gameplay)
• Premium items can alternatively be purchased using Silk (premium currency available on the official website)

4.2 External Purchases

Any purchase of premium game currency (Silk) must be made through the official Electus website (https://electus.online). The App does not process, facilitate, or handle any financial transactions.

5. Virtual Items and Currency

5.1 Bonus Spin Feature

The Bonus Spin feature allows users to spend in-app points for a chance to receive virtual game rewards. This feature:

• Uses only virtual in-app points (not real money)
• Awards only virtual game items
• Is for entertainment purposes only
• Does not constitute gambling under any jurisdiction

5.2 Alchemy Feature

The Alchemy feature allows users to earn virtual points through gameplay activities. Points earned have no cash value and are for in-game use only.

6. Chat Features

The App provides community chat functionality including Global Chat, Guild Chat, and Direct Messages.

6.1 Chat Data Retention

• Global Chat & Guild Chat: Messages are stored on our servers to provide chat history and enable moderation.
• Direct Messages: Private messages are not persistently stored on our servers. DM history is not retained once delivered and exists only during active sessions and on user devices.

6.2 Chat Conduct

When using chat features, you agree to:

• Treat other users with respect
• Not post offensive, abusive, or harassing content
• Not spam or flood chat channels
• Not share inappropriate or illegal content
• Not impersonate other users or staff members
• Not advertise or promote external services
• Not share personal information of others without consent
• Comply with all applicable laws

6.3 Chat Moderation

We reserve the right to:

• Monitor chat channels for violations
• Remove or hide messages that violate these Terms
• Temporarily or permanently restrict chat access for users who violate rules
• Report illegal activity to appropriate authorities

Moderation decisions are at our sole discretion and are final.

7. User Conduct

You agree not to:

• Use the App for any unlawful purpose
• Attempt to gain unauthorized access to the App or its systems
• Interfere with or disrupt the App's functionality
• Use automated systems or bots to access the App
• Exploit bugs or glitches for unfair advantage
• Share your account credentials with others
• Attempt to reverse engineer the App
• Harass, abuse, or harm other users
• Circumvent chat restrictions or bans

8. Intellectual Property

All content in the App, including but not limited to text, graphics, logos, icons, images, audio clips, and software, is the property of Electus or its licensors and is protected by copyright, trademark, and other intellectual property laws.

9. Push Notifications

By enabling push notifications, you consent to receive messages from us regarding:

• Game events and schedules
• Server maintenance and updates
• Account-related information
• Promotional content (which you may opt out of)

You may disable notifications at any time through your device settings.

10. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

10.1 Service Availability

We reserve the right to modify, suspend, or discontinue the App at any time without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the App.

10.2 Chat Availability

Chat services may be temporarily unavailable due to maintenance, technical issues, or moderation actions. We do not guarantee continuous availability of chat features.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ELECTUS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP.

We are not responsible for:

• Content posted by users in chat channels
• Loss of direct message history (as DMs are not persistently stored)
• Actions taken by other users
• Technical issues affecting chat delivery

12. Termination

We may terminate or suspend your access to the App immediately, without prior notice, for any reason, including if you breach these Terms. Upon termination, your right to use the App will cease immediately.

Violations of chat conduct rules may result in:

• Warning
• Temporary chat restriction
• Permanent chat ban
• Full account suspension from the App

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes by posting the updated Terms in the App or on our website. Your continued use of the App after changes are posted constitutes your acceptance of the modified Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Electus operates, without regard to its conflict of law provisions.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
